01Agreement to these terms
These Terms of Service (the “Terms”) are a binding agreement between you and your business (“you” or “Client”) and New Neighbor (“New Neighbor,” “we,” “us,” or “our”) governing your access to and use of our website and lead sourcing services (collectively, the “Service”).
By signing up, booking a demo, or otherwise using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a company, you represent that you have the authority to bind that company. If you do not agree, do not use the Service.
02What New Neighbor provides
New Neighbor is a territory-based lead sourcing service for home service businesses. We find high-intent homeowners and deliver them to you as leads — you own the outreach and the relationship. Depending on your plan, the Service may include:
- Monitoring public web sources, real estate listing feeds, county records, and licensed third-party data providers for signals that a homeowner needs services like yours;
- Identifying high-intent homeowners in the territories you subscribe to;
- Verifying and filtering contact information before a lead is delivered; and
- Delivering leads through your dashboard and by email or text alerts, along with periodic reporting.
The specific features, territory count, and lead volume available to you depend on the plan you select. We may improve, modify, or discontinue features of the Service over time.
03Eligibility and accounts
You must be at least 18 years old and operating a legitimate business to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of any account credentials, and for all activity that occurs under your account. Notify us promptly at hello@getnewneighbor.com if you suspect unauthorized use.
04Subscriptions, billing, and cancellation
The Service is offered on a flat monthly subscription basis. By subscribing, you authorize us (or our payment processor) to charge your payment method the recurring fee for your plan until you cancel.
- Renewal. Subscriptions renew automatically each billing period unless cancelled before the renewal date.
- Cancellation. You may cancel at any time. There are no long-term contracts and no per-lead surcharges. Cancellation takes effect at the end of the current billing period.
- No refunds. Except where required by law, fees already paid are non-refundable, including for partial billing periods.
- Price changes. We may change pricing on a prospective basis with reasonable advance notice; changes do not affect the period you have already paid for.
05Territory exclusivity
Certain plans grant you exclusive outreach rights to specific territories (for example, a county or ZIP code). Exclusivity means that, while your subscription is active and in good standing, we will not deliver leads from that territory to another New Neighbor client in the same service category.
Exclusivity is contingent on an active, paid subscription. If your subscription ends or payment lapses, your hold on a territory is released: territories freeze for 30 days after cancellation and then reopen to other operators. We do not guarantee that any particular territory will be available, and availability may change at any time.
06Your responsibilities
We source leads; you decide whether and how to contact them. All outreach to leads is sent by you, from your own accounts and systems. You agree that:
- The business information you provide is accurate, lawful, and not misleading;
- You are solely responsible for your outreach and follow-up, including compliance with the CAN-SPAM Act, the Telephone Consumer Protection Act and applicable do-not-call rules, and applicable state and federal consumer-protection and privacy laws;
- You are responsible for obtaining any consents required before calling, texting, or emailing a lead;
- You will promptly honor opt-out and “do not contact” requests you receive, and will notify us so we can suppress the contact from future lead data; and
- You will use leads and contact information solely for your own good-faith business outreach, and you will not resell, redistribute, or publish them.
07Acceptable use
You agree not to use the Service or the lead data it provides to:
- Send unlawful, deceptive, harassing, or fraudulent communications, or promote unlawful goods or services;
- Determine eligibility for credit, insurance, employment, or housing, or for any other purpose regulated by the Fair Credit Reporting Act — New Neighbor is not a consumer reporting agency, and the Service does not provide consumer reports;
- Circumvent suppression lists, territory limits, or plan limits;
- Scrape, harvest, or systematically export data beyond the leads delivered under your plan;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems; or
- Infringe the intellectual property or privacy rights of any third party.
We may suspend or terminate the Service immediately if we reasonably believe your use violates these Terms or applicable law, or creates risk to us, our other clients, or recipients.
08Leads, data, and no guarantee of results
Lead and contact data is sourced from public web sources, listing feeds, public records, and third-party providers. While we filter and verify data to reduce errors, we do not warrant that it is complete, current, or accurate, and we are not responsible for inaccuracies originating from third-party sources.
The Service delivers leads and opportunities, not guaranteed outcomes. We do not promise any specific number of leads, replies, appointments, jobs, revenue, or return on investment. Results depend on many factors outside our control, including your follow-up, offer, pricing, and market conditions.
09Intellectual property
The Service, including our software, content, and branding, is owned by New Neighbor and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your business name, branding, and the materials you provide, and you grant us a license to use them solely to operate and provide the Service.
10Third-party services
The Service relies on third-party providers (for example, data, alert-delivery, and payment providers). Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts, omissions, or availability.
11Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW NEIGHBOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13Indemnification
You agree to indemnify and hold harmless New Neighbor and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, the content and offers you provide, your communications with recipients, or your breach of these Terms or applicable law.
14Term and termination
These Terms remain in effect while you use the Service. You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that creates legal or operational risk. Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive.
15Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16Governing law and disputes
These Terms are governed by the laws of the United States and the state in which New Neighbor is organized, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in that jurisdiction, and you consent to their personal jurisdiction.
